What is an Ohio Medical Marijuana Processor Bond?

  • An Ohio Medical Marijuana Processor Bond is a $250,000 surety bond that is required to be posted by medical marijuana processors before they are issued a license, called a Processor Certificate of Operations, to conduct business in the State of Ohio.
  • A surety bond will need to be established for each processor license.
  • A copy of the bond must be submitted to the department before a certificate of operation is issued. The Processor shall have six (6) months from the date they are notified of selection for a provisional license to obtain a certificate of operation. Therefore, the bond must be obtained within that time period.
  • A Processor is an entity that has been authorized to manufacture medical marijuana products. Processors can obtain medical marijuana from one or more licensed cultivators and deliver or sell medical marijuana to one or more licensed retail dispensaries.
  • The State intends to issue up to forty (40) Processor provisional licenses before September 8, 2018.

  • Ohio Medical Marijuana Processor Bonds are in place to ensure the Principal (Medical Marijuana Processor) faithfully performs all obligations in connection with the license. The Principal and Surety are liable to the Obligee (Ohio Department of Commerce) for any of the following reasons:
    • Failure to adhere to the security plan approved by the department or otherwise operates the facility in a manner that allows for or results in theft, loss, or diversion of medical marijuana;
    • Engaging in activities prohibited under rule 3796:3-2-07 of the Ohio Administrative Code;
    • Engaging in activities prohibited under rule 3796:5-6-02 of the Ohio Administrative Code.
  • The Ohio General Assembly passed House Bill 523 on September 8th, 2016. This bill legalized medical marijuana in the state of Ohio and established the basic framework for Ohio’s Medical Marijuana Control Program (MMCP).
  • Three state agencies were given the responsibility of developing, implementing and overseeing the MMCP. The three state agencies and their respective roles are:
    • The Ohio Department of Commerce - is tasked with oversight of the medical marijuana cultivators, processors and testing laboratories in the state. The DoC’s role is also to develop a program that ensures the safety of the public and access to a safe medical product.
    • The State of Ohio Board of Pharmacy - is responsible for overseeing medical marijuana retail dispensaries, the registration of medical marijuana patients and caregivers, the approval of new forms of medical marijuana and coordinating the Medical Marijuana Advisory Committee.
    • The State Medical Board of Ohio - is responsible for certifying physicians to recommend medical marijuana and may add to the list of qualifying conditions for which medical marijuana can be recommended.
  • Ohio Administrative Code, Chapter 3796:3-1-05 Processor Financial Responsibility, stipulates the need for processors to, among other things, post a surety bond before a certificate of operation is issued.
  • The Obligee on the Ohio Medical Marijuana Processor Surety Bond is the Ohio Department of Commerce.
  • Ohio Medical Marijuana Processor Surety Bonds remain in full force and effect from the effective date until they are cancelled. Therefore, they will renew every year and the bonding company will bill for the bond on an annual basis. The bond may be cancelled by the surety with thirty (30) days written notice to the Obligee (Ohio Department of Commerce).
  • However, according to Ohio Administrative Code Chapter 3796:3-1-05, the department shall permit a reduction of the surety bond penalty by $75,000 upon the successful achievement of certain milestones.
    • After one year of full operation and compliance with state rules and regulations the bond amount may drop to $175,000.
    • After two consecutive years of full operation and compliance with state rules and regulations the bond amount may drop to $100,000.
    • After three consecutive years of full operation and compliance with state rules and regulations the bond requirement may be eliminated altogether, of course, this determination must be made by the Ohio Department of Commerce.
