What is a Florida Alcoholic Beverages and Tobacco Bond?

  • The Florida Alcoholic Beverages and Tobacco Bond is a surety bond that is required to be posted in order to be licensed to manufacture, distribute, or sell certain alcohol or tobacco products in Florida. There are several different license types and each requires a different surety bond amount that varies from as little as $1,000 up to over $100,000. All license types are written on the same bond form, Form DBPR ABT-6001.
  • Alcoholic Beverages:
    • Manufacturer or Bottler of Wine (AMW) requires a surety wine bond in the amount of $5,000. This license is needed to engage in the manufacturing or bottling of wine in Florida.
    • Manufacturer of Wine and Cordials (BMWC) requires a surety bond in the amount of $5,000. This license is needed to engage in the manufacturing of wines and cordials in Florida.
    • Manufacturer/Brewer of Malt Beverages/Beer (CMB) requires a surety brewers bond in the amount of $20,000. This license is needed for manufacturers engaged in the brewing of malt beverages (beer) in Florida.
    • Rectifier/Blender of Spirituous Beverages (ERB) requires a surety bond in the amount of $25,000. This license is needed to engage in the business of rectifying and blending spirituous beverages (liquor) in Florida.
    • Manufacturer/Distiller of Spirituous Liquor (DD) requires a surety bond in the amount of $25,000. This license is needed for distillers of spirituous liquor.
    • Distributor of Beer and Wine (JDBW) requires a surety bond in the amount of $25,000. This license is needed to distribute beer and/or wine to vendors and other distributors in Florida.
    • Distributor of Beverages in Dry Counties (EDB) requires a surety bond in the amount of $25,000. This license is needed to distribute alcoholic beverages
    • Distributor of Beer, Wine, and Liquor (KLD) requires a surety bond for liquor license in the amount of $100,000. This license is need to distribute spirituous (liquor), vinous (wine), and malt beverages (beer) to vendors and distributors in Florida.
    • Distributor of Spirituous Beverages (KLD2) requires a surety bond in the amount of $100,000. This license is needed to distribute spirituous (liquor), vinous (wine), and malt beverages (beer) to vendors and distributors in counties that have a population of 15,000 or less if the county in Florida is wet.
    • Distributor of Sacramental Wine (JDSW) requires a surety bond in the amount of $25,000. This license is needed to distribute only sacramental Wines to permit holders in Florida.
    • State Bonded Warehouse Permit (SBW) requires a surety bond in an amount of not more than $5,000 and not less than $1,000. The Division will decide the final bond amount. This permit is needed to operate a licensed warehouse to store alcoholic beverages including beer, wine, and/or liquor in the state of Florida.
  • Tobacco:
    • Cigarette Distributing Agent (CDA) requires a surety bond in the amount equal to 110% of the estimated tax liability for 30 days, but not less than $2,000. This license permits receiving cigarettes in interstate or intrastate commerce and storage in Florida.
    • Cigarette Wholesale Dealer (CWD) is comprised of two different types of cigarette distributors: Stamping Agents and Tax-paid distributors.
      • Tax-paid cigarette distributors are required to post a $2,000 surety bond. These distributors purchase already stamped (taxed) cigarettes from stamping agents and distribute them to retail dealers in Florida.
      • Stamping Agents are required to post a minimum surety bond in the amount of $45,000. Depending on the amount of business and tax liability the agent incurs by importing cigarettes, the state will require a larger bond to cover said liability. This license is needed to sell cigarettes to retail dealers in Florida for resale purposes only.
    • Cigarette Exporter (EXP) requires a surety bond in the amount equal to 110% of the estimated tax liability for 30 days, but not less than $2,000. This license is needed to transport tax-exempt cigarettes into state under bond for delivery beyond the borders of Florida.
    • Tobacco Wholesale Dealer/Distributor (TWD) requires a surety bond in the amount of $25,000 or more. The Division determines whether or not the $25,000 bond can sufficiently cover the payment of all taxes, penalties, and accrued interest which may be due to the state of Florida. If the $25,000 tobacco bond is not enough, then the Division shall require an additional bond in such amount that is deemed sufficient, sometimes up to hundreds of thousands of dollars. This license permits the sale of tobacco products to retailers in Florida. Tobacco products is defined as loose tobacco suitable for smoking, snuff, snuff flour, chewing tobacco, etc. This does not include cigars or cigarettes.
  • Note that unless otherwise stated, the figures described above are the maximum surety bond amounts required. If the Division of Alcoholic Beverages and Tobacco determines that the amount of business done by the manufacturer or distributor is of such volume that a bond less than the amount stated will be adequate to secure the payment of all taxes assessed or authorized by the Beverage Law, the Cigarette Law, and/or the Tobacco Product Law, then the division may accept a bond in a lesser sum.

  • Florida Tobacco and Alcoholic Beverages Surety Bonds are individually underwritten so the cost can vary and is dependent on the personal credit score of the applicant and the required surety bond amount; sometimes, personal financials and business financials may be required depending on the bond amount (usually over $50,000) and credit standing. Customers with good credit scores (generally 680 or higher) could qualify for a rate as low as 1% of the bond amount, with exception to bond amounts less than $10,000. In that case, the minimum bond premium could be as low as $100. Of course, we will always provide you with the lowest rates available on the market. And can typically handle all credit types and financial situations - from excellent to poor - as such those terms vary.
  • So for example, a $25,000 bond could cost as low as $250 for applicants with good credit. And a $5,000 bond could cost as low as $100 for an applicant with good credit.

Florida Alcohol and Tobacco TTB Bonds are in place to ensure Principals (licensees) pay all taxes due to the state of Florida. By posting the bond, the Principal is also guaranteeing they will comply with all of the rules, regulations, and provisions of Florida Statutes, Chapters 561-568 (FL Beverage Laws) and Chapter 210, Part I and Part II (FL Cigarette Laws and FL Tobacco Product Laws).

The Florida Department of Business and Professional Regulation, Division of Alcoholic Beverages and Tobacco is charged with licensing the alcoholic beverage and tobacco industry, collecting and auditing the taxes and fees paid by the licensees, and enforcing the laws and regulations of the industry. The Division requires a surety bond to be posted before certain licenses can be issued in pursuant to the Florida Beverage Laws (Florida Statutes, Chapters 561-568), the Florida Cigarette Laws (F.S. Chapter 210), and the Florida Tobacco Product Laws (F.S. Chapter 210). The Obligee on the bond is the Division of Alcoholic Beverages and Tobacco.

Florida Alcoholic Beverages and Tobacco Surety Bonds are continuous and run in full force from the effective date until canceled. The bond may be canceled and discontinued by the Surety by giving 60 days written notice to the Obligee (Division of Alcoholic Beverages and Tobacco). The bonding company will renew and bill for the alcohol and tobacco bond on an annual basis. For some licenses, it is likely that variations on business volume each year will require a different bond amount than the prior year.
