What is a Florida Class E Third Party Knowledge Exam Administrator Bond?
The Florida Class E Third Party Knowledge Exam Administrator Performance Bond is a $200,000 surety bond that is required to be posted by Third Party Administrators (TPA) seeking to operate a Third Party Driver License Examination Service for the purpose of administering Class E Knowledge Exams to the public.
In addition, TPAs that also administer Class E Driving Skills Exams must submit a separate $200,000 surety bond called the Florida Class E Third Party Driving Exam Administrator Performance Bond.
So, if a Third Party Administrator wishes to conduct both Class E written knowledge tests and Class E driving skills tests, they must post two bonds in the total amount of $400,000.
TPA Class E Services Surety Bonds are individually underwritten so the cost can vary and is dependent on the personal credit of the applicant as well as personal financials and business financials. Customers with good credit scores (generally 680 or higher) and overall good financials could qualify for a rate as low as 1% of the bond amount. TPA Class E Services Bonds are in place to ensure the Principal (TPA) follows all of the rules and regulations of Florida Statutes, Chapter 322, the Florida Administrative Code, Rule 15A-1, as well as all applicable provisions of the Class E Knowledge Exam Contract. These provisions include the safekeeping of exam question bank and applicant data, and the proper administration of online and proctored exams.
The Florida Department of Highway Safety and Motor Vehicles (DHSMV) regulates and administers licensing for TPA Class E Services. Florida Statutes, Section 322.56 provides authority for the Department to contract with third party entities to administer Class E Knowledge Exams. Section 322.56 also provides the DHSMV the authority to adopt rules necessary to implement the law. The Obligee on the bond is the Florida Department of Highway Safety and Motor Vehicles.
TPA Knowledge Exam Surety Bonds run in full force from the effective date for a definite period as defined in the Class E Knowledge Exam Contract. Currently, the contracted period is for (3) three years, therefore the bond will need to be in place for (3) three years unless the contract is suspended, terminated, or canceled. The surety bond is an annually renewable bond and is billed for and renewed on an annual basis. The bond then would need to be renewed for two additional terms to follow the total three (3) year term of the contract.
